2. What ACEL-Pro is
ACEL-Pro is a pupil-level evidence platform designed to support schools and local authorities
in building a clearer picture of mathematical learning over time.
It helps schools gather structured evidence of pupil progress, support teacher judgement,
and provide leaders with clearer information about learning, gaps and attainment.
ACEL-Pro is designed to sit alongside existing maths teaching and assessment practice.
It does not require a curriculum change.
3. Acceptance of these terms
These Terms and Conditions apply to the use of the ACEL-Pro website, platform, content,
resources and related services.
By accessing or using ACEL-Pro, the school, local authority, organisation or individual user
agrees to use the service in line with these terms.
Where a school, local authority or organisation has a separate signed service agreement,
order form, contract or written agreement with ALTA Education, that document will take
priority if there is any conflict with these Terms and Conditions.
4. Who may use ACEL-Pro
ACEL-Pro may be used by schools, local authorities, authorised staff, pupils and other
approved users.
Access is provided only for the agreed school, local authority, organisation, pilot group,
class, cohort or user group.
Access must not be shared with anyone outside the agreed organisation or pilot group unless
this has been agreed in writing by ALTA Education.
5. Account access and security
Some parts of ACEL-Pro require users to create or use an account.
Users are responsible for:
- keeping login details secure
- not sharing passwords or access links
- using only their own account

telling the school, local authority or ALTA Education if they believe an account has
been misused

following any reasonable security instructions given by the school, local authority
or ALTA Education
Schools and local authorities are responsible for deciding which staff should have access
and for telling ALTA Education when access should be added, changed or removed.
ALTA Education may suspend an account where there is a reasonable concern about security,
misuse or unauthorised access.
6. Customer responsibilities
Schools, local authorities and other customer organisations are responsible for:
- confirming which users, schools, classes or pupil groups should be set up
- providing accurate setup information
- ensuring only necessary pupil and staff information is provided
- managing internal permissions and user access
- ensuring users understand how ACEL-Pro should be used

completing any internal data protection, DPIA, IT/security or procurement checks
required before pupil data is shared
-
using ACEL-Pro in line with their own policies and legal responsibilities
ALTA Education is not responsible for limited or incomplete evidence where ACEL-Pro is not
used by participating staff, where setup information is not provided, or where pupil data
entered into the system is incomplete or inaccurate.
7. Data protection and privacy
Use of ACEL-Pro may involve the processing of personal data.
Personal data is handled in line with the
ACEL-Pro Privacy Notice.
When a school or local authority uses ACEL-Pro, the school or local authority will usually
act as the Data Controller.
ALTA Education Limited will usually act as the Data Processor.
This means ALTA Education processes personal data only to provide ACEL-Pro and only in line
with the instructions of the school or local authority.
Schools and local authorities are responsible for identifying the lawful basis for processing
personal data and for completing any required DPIA, information governance or IT/security
review.
ALTA Education will provide reasonable information needed to support these checks.
8. Professional judgement
ACEL-Pro is designed to support teacher and leader judgement.
It does not replace professional judgement.
System-generated indicators, evidence summaries, progress information and review prompts are
intended to support decisions about teaching, learning, progress, support, moderation and
achievement of a level.
Final decisions about pupils, teaching, support, attainment, reporting and wider school action
remain the responsibility of the school, local authority and relevant professional staff.
ACEL-Pro does not make decisions about pupils that have legal or similarly significant effects.
9. Acceptable use
Users must use ACEL-Pro only for legitimate educational, assessment, moderation, leadership,
planning or professional learning purposes within the agreed school, local authority or
organisation.
Users must not:
- share login credentials
- allow unauthorised access
- copy, publish, distribute or share ACEL-Pro content outside the agreed organisation
- reproduce ACEL-Pro content for commercial use or resale
- create derivative commercial resources using ACEL-Pro materials
- scrape, reverse engineer, download in bulk or extract platform content, questions, data or code
- attempt to bypass security, access controls or usage limits
- use ACEL-Pro in a way that is unlawful, misleading or harmful

upload or enter information that is unnecessary, inappropriate or outside the agreed
purpose of use

use ACEL-Pro in a way that could damage the platform, other users or ALTA Education
Breach of this section may result in suspension or termination of access.
10. Intellectual property
All ACEL-Pro platform content, questions, tasks, software, code, design, structure, resources,
written materials, training materials, branding and related intellectual property belong to
ALTA Education Limited or its licensors.
Schools, local authorities and authorised users are granted a limited, non-exclusive,
non-transferable right to use ACEL-Pro during the agreed access period for internal educational
purposes only.
ACEL-Pro materials must not be shared externally, copied for wider use, uploaded to other
platforms, sold, sublicensed, published, adapted for commercial use, or used outside the agreed
school, local authority or organisation without written permission from ALTA Education.
Pupil data entered into ACEL-Pro remains the responsibility of the school or local authority
as Data Controller.
11. Service availability, updates and changes
ALTA Education will take reasonable steps to keep ACEL-Pro available and working properly.
There may be times when access is interrupted because of maintenance, updates, technical issues,
hosting issues, security work or circumstances outside ALTA Education’s reasonable control.
ALTA Education may update, improve, change or remove features from ACEL-Pro from time to time.
Where a change is likely to materially affect a school or local authority’s use of ACEL-Pro,
ALTA Education will take reasonable steps to communicate this.
12. Support
ALTA Education will provide reasonable technical and implementation support during the agreed
access period.
Support may include help with account setup, user access, platform use, technical issues,
onboarding and reasonable information needed for data protection or IT/security review.

Any support beyond the agreed scope, including additional training, bespoke reporting, bespoke
development or extended implementation support, may need to be agreed separately.
13. Fees and payment
Fees for ACEL-Pro are agreed separately through a proposal, order form, service agreement,
contract, invoice or other written agreement.
Unless otherwise agreed in writing:
- fees are payable in advance
- invoices are issued electronically
- payment is due within the payment period stated on the invoice or agreement
- access may be paused if payment is not received within the agreed timeframe
Published website information does not override a signed service agreement, order form,
contract or written pricing agreement.
14. Term, access period and termination
Access to ACEL-Pro is provided for the agreed access period.
Access may be linked to a pilot, subscription, school agreement, local authority agreement
or other written arrangement.
ALTA Education may suspend or terminate access where:
- these terms are breached
- payment is overdue
- there is suspected misuse
- there is a security risk
- access is being used outside the agreed scope

continued access would create legal, data protection, safeguarding or technical risk
At the end of an agreed access period, access will end unless continuation or renewal is agreed
separately.
15. Retention, deletion and export
Personal data is retained and deleted in line with the ACEL-Pro Privacy Notice and any applicable
service agreement or data processing agreement.
When a school or local authority stops using ACEL-Pro, they may request an export of relevant
data before deletion, where technically possible.
After the contract or access period ends, or on written instruction from the Data Controller,
personal data will be deleted from live systems within an agreed period.
Backup copies may remain for a limited period as part of normal hosting and backup processes
before being overwritten or deleted.
16. Confidentiality
Both parties will treat non-public information shared as part of the service relationship as
confidential.
This may include pricing, platform information, pupil information, staff information,
school-level information, authority-level information, non-public materials and any other
information that would reasonably be understood as confidential.
This obligation continues after the end of the access period or service relationship.
17. Marketing and public reference
ALTA Education will not use a customer’s logo, publish a case study, issue a public announcement,
or publicly name a school or local authority as an ACEL-Pro customer without written permission.
ALTA Education may refer privately to relevant experience when discussing ACEL-Pro with other
schools, local authorities or partners, unless the customer asks ALTA Education not to do so.
18. No guarantee of outcomes
ALTA Education will provide ACEL-Pro with reasonable skill and care.
ACEL-Pro is intended to support evidence, teaching decisions, moderation, leadership insight and
professional judgement.
ALTA Education does not guarantee any specific attainment outcome, inspection outcome,
moderation outcome, improvement outcome, funding decision, rollout decision or educational result.
19. Liability
Nothing in these terms limits any liability that cannot legally be limited.
Subject to that, ALTA Education is not responsible for:
- indirect losses
- loss of expected savings or benefits
- loss caused by inaccurate, incomplete or delayed information provided by the customer
- decisions made by the customer using incomplete or inaccurate information

failure to achieve a particular educational, attainment, inspection or improvement outcome
-
interruption caused by events outside ALTA Education’s reasonable control
Where liability can legally be limited, ALTA Education’s total liability will not exceed the
fees paid or payable for the relevant ACEL-Pro service during the relevant access period, unless
a separate signed agreement says otherwise.
20. Force majeure
ALTA Education will not be responsible for failure or delay caused by events outside its
reasonable control.
This may include serious technical outages, hosting provider issues, cyber incidents, natural
disasters, industrial action, government action, public health disruption or other events that
could not reasonably have been prevented.
ALTA Education will take reasonable steps to restore service or continue delivery where possible.
21. Changes to these Terms and Conditions
ALTA Education may update these Terms and Conditions from time to time.
The most recent version will be published on the ACEL-Pro website.
Continued use of ACEL-Pro after updated terms are published will mean continued acceptance of
those terms, unless a separate signed agreement states otherwise.
22. Governing law
These Terms and Conditions are governed by the law of Scotland.
Any disputes will be subject to the jurisdiction of the Scottish courts, unless a separate signed
agreement states otherwise.
